Welcome to Art by Abish. By accessing our website and purchasing our products, you agree to be bound by the following terms and conditions.

1. Artistic Process & AI Disclosure

Art by Abish creates unique works using a hybrid of digital methods, including Artificial Intelligence (AI), digital painting, and mixed media. By purchasing from us, you acknowledge that the artwork is a digital/physical hybrid creation.

2. Intellectual Property

All content on this site, including images, text, and logos, is the property of Art by Abish. Purchase of a physical print, canvas, or original piece does not transfer copyright to the buyer. You may not reproduce, resell, or distribute the artwork for commercial purposes without express written permission.

3. Custom Commissions & Deposits

  • Deposit: All custom commissions require a 50% non-refundable deposit once the project is confirmed and production begins.

  • Cancellation: If a project is cancelled after production starts, the 50% deposit will be retained to cover labor and material costs.

  • Final Approval: We will provide a preview of the custom work. Once approved and shipped, the sale is final and non-refundable.

4. Product Accuracy

We strive to display the colors and textures of our art as accurately as possible. However, we cannot guarantee that your computer monitor's display of any color will be 100% accurate to the physical print.

5. Shipping & Damage

Art by Abish is not responsible for delays caused by the carrier. However, if an item arrives damaged, we will typically provide a free replacement of the exact same piece upon receipt of photographic evidence within 2 week of delivery.

6. Governing Law

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of New Jersey.

7. Changes to Terms

We reserve the right to update or change our Terms of Service at any time. Your continued use of the website following the posting of any changes constitutes acceptance of those changes.
